| Abstract | U ovome radu autor analizira pravna pitanja građanskopravne odgovornosti luka nautičkog turizma. Razlozi za analizu ovih pitanja jesu značajne promjene koje su se u vezi s njima dogodile u recentnom periodu. One su bile izražene kroz dva različita aspekta koji su međuovisni, a konačno su nužno utjecali na građanskopravni status luka nautičkog turizma. S jedne strane, u proteklom periodu koji počinje u posljednjim desetljećima prošlog stoljeća uočljiv je intenzivan porast broja ugovora o vezu. Pri tome je zamjetan i trend daljnjeg povećanja broja takvih ugovora zbog daljnje izgradnje novih luka nautičkog turizma ili širenja postojećih, čime se povećava broj pružatelja ove usluge i samih ugovora o vezu. Navedeno je uzrokovalo različita, neusklađena i nestandardizirana ugovorna uređenja tog donedavno neimenovanog ugovora, uz neusklađenu sudsku praksu. S druge strane, upravo zbog tih razloga zakonodavac je prvi put pristupio uređenju ugovora o vezu kao imenovanog ugovora, što je učinjeno izmjenama i dopunama Pomorskog zakonika 2019. godine (dalje ZIDPZ2019).
Za luke nautičkog turizma, odnosno marine, ugovor o vezu predstavlja nužan i najčešći ugovorni odnos u koji one stupaju s korisnicima vezova kod pružanja usluge veza, a zbog čega je taj ugovor od temeljnog značenja za uređenje građanskopravne odgovornosti luka nautičkog turizma. Pozitivnim upravnopravnim uređenjem marine su razvrstane kao jedina vrsta luka nautičkog turizma, zbog čega se u radu u pravilu koristi pojam „marina“ umjesto pojma „luka nautičkog turizma“. Kako je naznačeno, u nedostatku zakonskih rješenja za ovaj ugovorni odnos do donošenja ZIDPZ2019 primjenjivali su se srodni instituti obveznog prava uz neusklađena i nedosljedna ugovorna uređenja. Uz navedene značajke, osobitost ugovora o vezu je i njegova forma, jer se ti ugovori u pravilu u svojim ključnim uvjetima dopunski uređuju u formi općih uvjeta ugovora od strane marina kao pružatelja usluge veza.
Autor stoga razmatra pravnu prirodu i značajke ugovora o vezu i općih uvjeta tog ugovora, kako u razdoblju do njegova uređenja kao imenovanog ugovora kroz ZIDPZ2019, tako i povodom njegove daljnje primjene temeljem novoga zakonskog uređenja. Završno, autor iznosi prijedloge i zaključke povezane sa zakonskim uređenjem ugovora o vezu nakon njegova uređenja kao imenovanog ugovora u Pomorskom zakoniku. |
| Abstract (english) | In this dissertation, the author analyses the legal issues of civil liability for nautical tourism ports. The reasons for analysing these issues lie in the significant changes that have taken place in this area in recent decades. They are expressed through two interrelated aspects that have ultimately impacted the civil liability status of nautical tourism ports. On the one hand, an intensive increase in the number of contracted berths has been recorded, a trend that began in the final decades of the 20th century. This trend continues to increase due to the ongoing construction of new nautical tourism ports or the expansion of existing ports, thereby also increasing the number of service providers and the number of berth contracts. This has resulted in a range of unaligned and unstandardised contractual practices of this previously unnamed contract, with a further lack of standardised court practice. On the other hand, for these very reasons, the legislator has taken on the task of governing the berth contract as a named contract for the first time, as seen in the amendments to the Maritime Code of 2019 (hereinafter: AMC2019).
For these nautical tourism ports, called marinas, the berth contract is an essential contractual agreement concluded with berth users for the provision of berth services. Accordingly, this contract is of fundamental significance for the regulation of the civil liabilities of nautical tourism ports. Through positive administrative and legal provisions, marinas are classified as the only type of nautical tourism port, and therefore in this dissertation, the term “marina” will be used to denote any “nautical tourism port”. As stated, until the adoption of the AMC2019, due to a former lack of any legal solutions for this contractual relationship, the related institution of compulsory law was applied alongside the unaligned and inconsistent contractual regulations. A particularity of the berth contract is in its form, for as a rule, these contracts are concluded in the shape of general terms contracts by the marine, as the provider of berth services.
The author considers the legal nature and properties of berth contracts and the general terms of these contracts, both in the period prior to its regulation as a named contract through the AMC2019, and upon its further application based on the new legal regulations. Finally, the author provides recommendations and conclusions concerning the legal regulation of berth contracts following its regulation as a named contract in the Maritime Code. |
